These Terms govern your use of www.dabmediadesign.com and services provided by DAB Media Design (“we,” “us,” or “our”). By using our website or purchasing services, you agree to these Terms. Booked services are also subject to our separate Booking Terms.

SERVICES & ELIGIBILITY

Our Services

DAB Media Design provides professional real estate photography, aerial/drone media, floor plans, visual media, and related photography and marketing services.

Services, packages, pricing, availability, and deliverables may change periodically.

Eligibility & Authorization

By booking services, you represent that you are legally capable of entering into an agreement and are authorized to request services and provide necessary property access.

If acting for an owner, agent, brokerage, business, or other party, you represent that you have appropriate authority to do so.

WEBSITE USE

You may use our website only for lawful purposes.

You may not attempt to gain unauthorized access to our systems; interfere with website security or operation; introduce malicious software; manipulate appointment availability, pricing, or payments; scrape website content without authorization; impersonate another person; or otherwise use the website unlawfully.

We may restrict access when reasonably necessary to protect our customers, website, systems, or business.

CUSTOMER INFORMATION & PRICING

Information Accuracy

You are responsible for providing accurate customer, property, scheduling, service, and access information.

Materially inaccurate information may result in pricing adjustments, delays, service modifications, or scheduling changes.

Pricing

Prices are stated in U.S. dollars unless otherwise indicated and may vary based on property characteristics, square footage, selected services, upgrades, travel, and project requirements.

Pricing may change for future purchases. Material pricing or service-description errors may be corrected before the affected service is performed.

PAYMENTS & BOOKINGS

Online payments may be processed through Stripe or another authorized payment provider.

A payment session, authorization, or temporary appointment hold does not by itself create a confirmed booking.

Booking confirmation, appointment holds, cancellations, rescheduling, refunds, property readiness, and other appointment-specific matters are governed by our separate Booking Terms.

When Booking Terms specifically conflict with these general Terms regarding an appointment, the Booking Terms control for that appointment.

INTELLECTUAL PROPERTY & MEDIA

Website Content

DAB Media Design's website, branding, logos, original text, graphics, design elements, photographs, videos, and other original materials are protected by applicable intellectual-property laws.

They may not be commercially reproduced, distributed, modified, or exploited without authorization except as permitted by law.

Client Media

Unless expressly transferred through a separate written agreement, DAB Media Design retains copyright ownership of photographs, videos, aerial media, floor plans, and other original creative works it produces.

Customers receive a license appropriate to the purchased service. Purchasing services does not automatically transfer copyright.

Media may not be resold, independently relicensed, or transferred for unrelated commercial use without authorization.

Portfolio Use

Unless otherwise agreed in writing or restricted by law, DAB Media Design may use media it creates for portfolios, websites, social media, advertising, demonstrations, competitions, and other legitimate promotional purposes.

Customers requiring confidentiality should communicate that requirement before services are performed.

CUSTOMER RESPONSIBILITIES

Customers are responsible for providing accurate information, obtaining appropriate authorization for property access and photography, and cooperating with reasonable requirements necessary to perform the requested services.

Specific property-readiness, access, scheduling, weather, drone, cancellation, and service-delivery requirements are addressed in our Booking Terms.

THIRD-PARTY SERVICES & WEBSITE AVAILABILITY

Our website and operations may use third-party providers for hosting, payments, databases, scheduling, communications, analytics, and related technologies.

We do not control the independent operation of those services and cannot guarantee uninterrupted availability.

We may also modify, maintain, suspend, or discontinue website features when reasonably necessary for security, maintenance, operational, or business purposes.

SERVICE RESULTS

DAB Media Design uses reasonable professional judgment and care when performing services.

Creative results may vary based on property conditions, weather, lighting, staging, access, equipment, services selected, and professional judgment.

Unless expressly agreed otherwise, we do not guarantee that media will produce a particular number of inquiries, property sale, rental, closing, appraisal result, listing performance, or other business outcome.

WARRANTIES & LIABILITY

To the extent permitted by law, our website is provided on an “as available” basis, and we do not guarantee uninterrupted or completely error-free operation.

To the fullest extent permitted by law, DAB Media Design is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the website or services.

Our aggregate liability arising from a particular purchased service will not exceed the amount actually paid to DAB Media Design for that service, except where liability cannot legally be limited.

INDEMNIFICATION & EVENTS OUTSIDE OUR CONTROL

To the extent permitted by law, you agree to indemnify DAB Media Design against third-party claims resulting from your unlawful use of our services, material violation of these Terms, or failure to obtain authorization you represented you possessed.

We are not responsible for delays or inability to perform caused by circumstances beyond our reasonable control, including severe weather, emergencies, government actions, utility or internet failures, transportation disruptions, third-party outages, or similar events.

PRIVACY

Our Privacy Policy explains how personal information may be collected, used, stored, processed, and disclosed through our website, booking system, payments, scheduling, and services.

GOVERNING TERMS

Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.

To the extent permitted by law, disputes will be subject to the appropriate state or federal courts located in North Carolina.

Severability & Waiver

If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision does not waive that provision or another right.

Entire Agreement

These Terms, together with our Privacy Policy, applicable Booking Terms, and any applicable service-specific written agreement, constitute the agreement governing the applicable website use and services.

A separately signed written agreement expressly conflicting with these Terms controls to the extent of that conflict.
